Assault is the fact that you touch them at all, and battery is like when a cat plays with a mouse it caught (for lack of a better example). Think of battery as a word that describes the depth of what’s going on.

Battery is unlawfully causing bodily harm to another individual. Assault is, more or less, the intent to commit battery.

If I swing a bat and you and miss, it’s assault. If I swing a bat at you and hit, it’s assault and battery.
