Eli5: If war crimes can be punished, why isn’t all war punished?

You don’t ban something you might be doing for your own gain.
If we punished every single war we would be actively damaging one of humanity’s most profitable businesses.
Also some wars exist also in support of noble causes.
So we ban some practices that are universally accepted as unnecessarily inhumane, but we leave the door open to “good” wars.
