How can they regulate it at all if they dont need to submit the app to Apple?

Because while you don’t have to sell your app through the app store, it still has to be signed (they call it notarized) by Apple. Without this notarization, an app will not run on an iOS device, regardless of what store it’s from

Because they still need to submit their app to Apple.

Side loading by Apple’s definition is nothing like side loading on Android.

Only alternative app stores are allowed not individual apps. Those app stores need to be certified by Apple and all apps they distribute must still be signed by Apple.
