Well, if the employer withholds the tips it is wage theft, and they will get in _serious_ trouble for that one. Withholding tips is a crime, and if an employer does it (outside of a few narrow exceptions) the employee is owed both lost tips and damages.
But ultimately, you don’t know for sure. You just have to trust that a business is following the law here, just like you trust they are following dozens of other laws for their business.
