If a person is given the chance of pleading guilty or innocent. Why would someone choose to plead innocent if pleading guilty gives a lesser punishment.
What happens if they plead innocent? Does the case remain open?
The case remains open and goes to court (usually). Plea bargains are sometimes offered in return for a guilty verdict in order to save the cost of court proceedings.
Bringing a case to court when it SHOULD have been pled can get you extra punishment from an overworked court.
