why do some musicians get away with plagiarising music and others don’t?

A bit of an oversimplification but why is it some musicians get sued for seemingly the smallest similarities in their songs to others, whilst the theme tune of the Flight of the Conchords and the opening of ‘Sing’ by Ed Sheerhan are ludicrously similar and no one calls Ed Sheehan out. A quick google search showed a few others have noticed but ultimately no one seems to care. So what are the parameters of a successful plagiarism suit and is it just not worth the time and hassle?

Thanks

That kind of action is usually taken by the party that feels like they have been ripped off. If Flight of the Conchords hasn’t complained, Ed Sheeran doesn’t have a problem.

Just listened to it. It’s way too basic to invoke plagiarism. It’s just a common straight drum pattern and some simple guitar chords on top. It’s too likely that it’d pop up in different places independently, so the assumption it’s stolen is too flimsy just on that basis.

And like the other comment said, it’s no problem either way if they don’t sue.
