eli5 What makes injury lawyers so common?

You almost never see commercials or advertisments for other types of lawyers. I’m sure there are tons of different types and specialities. Why do you only see advertisments for injury lawyers?

Most people in their day to day are either not aware of how many things they could go to court for for a potential big payout, or simply do not bother to do so. But the law is a tricky thing and there’s tons of cases that could be swing in one’s favor, even ridiculous ones, and most companies don’t want to deal with such issues and usually settle out of court if they can’t immediately shut down a claim. So for lawyers, there’s tons of potential work that pays well but they simply have to find the right clients. Most people don’t go to court soas to not have to pay the associated fees, particularly the lawyer’s payment. The usual trick with such cases, is that the lawyer is paid out of the settlement, so to the client it’s often either free or very cheap compared to other cases. They advertise heavily because they want people to be on the lookout for potential claims, and not simply let incidents go by. They want a person’s first thought to be “I’m gonna sue” when something like an accident happens.

In America, legitimate companies have liability insurance. Something as simple as slipping on a floor could cost a lifetime of pain. Threatening to sue often forces a settlement. It’s an easy gig.

Many specialized practice areas within law don’t advertise to the public because they primarily don’t deal with the public. If your area of practice is intellectual property (patent, copyright, trademarks, etc.) you are unlikely to gain a lot of clients by advertising on billboards or on TV. If you do tax law, you are probably working with high net worth individuals, corporations or business entities and gain new clients through referrals, same with mergers and acquisitions, etc. If you do real estate law, people seek you out when they have a real estate transaction – often through referral from a real estate agent, escrow company, etc.

You do see advertising for lawyers who practice family law (divorce, custody, etc.), estate law, immigration, and personal bankruptcy – because like personal injury, their clients are the general public.

Personal injury is an area of law that is very applicable to average people, because people get into car accidents, slip and falls, etc. Therefore, personal injury lawyers advertise on billboards and late night television. To go to the other extreme, private equity m&a is not something that has a particularly broad audience. Firms that do private m&a advertise a great deal, but since the typical person is not a hedge fund, they generally do not see these advertisements.
