Consent isn’t biological and doesn’t leave traces.

However you can tell from the state of a body that someone recently had sex or had rough sex or had sex they probably didn’t enjoy very much.

This is not fool proof, as people get up to all kinds of shit with each others consent.

On the other hand rape does not have to be violent. People can be coerced into sex against their will and human bodies react to these things in weird ways that don’t necessarily imply consent.

So at best you get not evidence but at least some indication.

And when you have a dead body that shows such signs as bruises, vaginal/anal tearing and defensive wounds it may not be 100% proof, but at least a strong indicator that questions need to be asked.

Asked an adult question, get an adult answer:

Rape is an act of violence.
Any doctor would notice the “normal” little tearing in the vagina or anus after penetration, but a forensic doctor suspecting rape would look for clues of bonding around wrist and legs, signs on the skin , under the nails for scratches, signs of arousal, the presence of added lubrificants, and a full report to check for drugs and alchool.

Of course in not easy to have 100% certainty, but there are been many cases where they had enough evidence to convince a court of law that sex wasn’t consensual.

One answer I see missing from here is the specific answer in the case of post mortem rape, where trauma (tears and abrasions to the victims genitals – on its own isn’t 100% proof of rape coz some people like it rough) to the genitals leaves no blood spilling out which implies the cuts/tears occurred after the heart stopped beating (genital trauma in alive person would have bleeding from the injuries), and therefore pathologists can tell the sex was non-consensual as a dead person can’t say no

DNA presence, if applicable, and severity of the wounds. A 15cm tear doesn’t leave much doubt. And such tears can happen easily without consent, due to body reactions. This being said, many rapes are non violent and/or can leave little to no traces. This is why in an investigation it’s not the only thing taken into account.

This absolutely terrifies me and confirms that BDSM and whatnot is objectively a ludicrously stupid idea, because there’s absolutely no way whatsoever to prove it wasn’t intentional

And let’s be honest, it’s 2023, if it looks to violent people of a certain assigned sex at birth will be convicted of rape 100% of time, because in our society there’s no presumption of innocence in one of the two sexes.

For the record I’m not male, but I do *look* male which is part of why this terrifies me so much
