DNA presence, if applicable, and severity of the wounds. A 15cm tear doesn’t leave much doubt. And such tears can happen easily without consent, due to body reactions. This being said, many rapes are non violent and/or can leave little to no traces. This is why in an investigation it’s not the only thing taken into account.
